Car Accident Lawsuits

A car accident lawsuit is filed by the injured party or by relatives or friends on behalf of the injured party. Since a car accident occurs when the car is faulty or due to another driver’s negligence, it makes sense to file a case either against the manufacturer or the driver who caused the accident due to reckless driving. Some lawsuits have also been filed against the government for negligence that could have resulted in bad road conditions that might have caused an accident like a roll over or skid.

Most car accidents happen on busy roadways such as expressways, freeways, or highways with high speed limits. In such instances, if even just one driver neglects to follow proper driving rules or guidelines, it might result in a pileup resulting in excessive property damage and personal injuries. Teenagers who do not follow basic safety rules such as wearing a seat belt and passing with proper signals cause many car accidents. People who drink alcohol or take drugs are another major cause of car accidents are usually held liable if involved in an accident.

Car Accident Injuries - Causes and Preventive Measures

Car accidents that cause injuries have happened virtually since automobiles were invented. The first recorded accidental injury occurred in 1869. An Irish woman named Mary Ward was thrown out of the steam-powered carriage she was riding in when it hit an especially deep rut in the road. She was immediately crushed by one of the wheels, her injuries causing an instantaneous death. Her cousin had actually been the inventor of this new type of vehicle, in a cruel example of irony.

Over the last 25 years or so, car accident injuries resulting in deaths have declined an impressive 50% worldwide. This is due primarily to increased emphasis by both governments and car manufacturers on safety, including the standard use of air bags to reduce the number of severe injuries and deaths caused by front and side car-to-car collisions.

Alcohol Related Car Accidents

The alarming figures with regard to the number of deaths caused by car accidents that involve alcohol have prompted state governments and the Federal Government to take critical steps to prevent fatalities. One of these steps is to lower the allowable blood alcohol concentration (BAC) from 100 mg/dl to 80 mg/dl. However, such measures have proven to be inadequate as more recent figures show a dramatic increase in deaths caused by car accidents involving alcohol. More stringent laws have to be enacted to prevent these accidents, which may include imposing stiffer penalties for DUI or driving under the influence cases.

Recent figures show that instead of the expected decrease in the number of alcohol related deaths as a result of imposing a lower BAC, quite the opposite has occurred. In the last ten years, around 250,000 people died in alcohol related car accidents in the United States. Figures show that 16,000 people were killed in the year 2000, due to alcohol related accidents. In 2004, that figured climbed to 25,000. This means that 500 people die every week and 71 people die everyday in alcohol related car accidents.

Car Accident Checklist: Are You Prepared?

I’ve got a confession to make. I’ve been in a car accident before. Granted, it wasn’t my fault at all (both my opinion and the insurance company’s opinion). However, once it happened, I realized that I should have been better prepared for the car accident the day it happened. Since I realized this, I decided to make a checklist for things to have in case of a car accident. Here we go

1)Insurance Papers. Make sure you have your insurance papers ready to give to the other party in case they need to see them. These can also come in handy to give to the Police if they arrive on the scene of the accident. In some states, having car insurance is mandatory for the operation of a motor vehicle and you can be fined if you don’t have any insurance. Make sure you insurance paperwork is in order before finding out that it is necessary to have.

The Makings of a Safe Car

Over the years, the minimization of vehicular related accidents has been gaining ground. In fact, different sectors of society have contributed to ensure that motorists should be protected from unnecessary road mishaps. The government, car manufacturers, and even motorists and passengers themselves have been conscientious about this, making plans and creating devices in order to decrease the possibility of road hazards.

There have been countless pieces of legislation enacted by the government in order to ensure the reduction of vehicular accidents. The government has enacted a law about the use of seatbelts. There is also a prescribed speed limit for vehicles. Even the use of alcoholic beverages has been banned if a person has been designated to drive a vehicle. Car manufacturers, on the other hand, have devised various ingenious mechanisms to reduce the impact of collision and accidents. Brakes, tires, air bags, safety belts, seat belts are among the many things added into a car to ensure the safety of its users and passengers. These and many others are cautious steps and devices designed in order to curb road and vehicular accidents.

Accidents may happen due to a defect in the car or due to reckless driving of the driver. Of course, it could be possible that accidents occur due to the fault of another driver even when the injured party has been following the rules. Even though it is practically impossible to expect everyone to follow the rules and regulations while on the road, it would certainly make some difference if all of them try.
